Know all men by these presents that I Thomas Heywood of the Nunnery in the parish of KK Braddan in the Isle of Man, gentleman, with the full consent and approbation of Hester my wife and together with her for divers good causes and considerations but more especially for and in consideration of the sum of ten pounds ten shillings of lawful British currency to us in hand paid at the signing and delivery of these presents which we do hereby acknowledge to have had and received of and from the hands of Philip Higgins of the town of Douglas, within the Isle of Man aforesaid, barber, perukemaker as also in the further consideration of the sum of twenty shillings of lawful money British currency to be paid yearly unto the said Thomas Heywood of the Nunnery, his heirs, executors, administrators and assigns forever upon the second day of February out of the premesis hereafter mentioned and demised by him the said Philip Higgins, his heirs, executors and assigns, and it is also covenanted that whatever buildings and dwelling houses, warehouses, yards or any other improvements whatsoever that shall be erected upon the premises hereafter mentioned the said edifices or improvements shall stand and forever be deemed as a collateral security for the annual payment forever of the abovementioned sum of twenty shillings British currency to the said Thomas Heywood, his heirs, executors, administrators and assigns

And I the said Thomas Heywood together with the said Hester my wife have given, granted, demised, passed over and sold and by these presents do give, grant, demise, pass over and forever absolutely sell unto him the said Philip Higgins, his heirs, executors, administrators and assigns all the right, title and interest of we the said Thomas Heywood and Hester my wife that we now have or hereafter may have in and unto a certain parcel of quarterland being part or parcel of the land of the said Thomas Heywood, commonly called or known by the name of the Nunnery Howe, situate in the said parish of Kirk Braddan and is opposite to the said town of Douglas and herein after more ... described (that is to say) all .... or parcel of the said Howe land in the said Isle of Man and on part whereof ... house or cellar was formerly erected and contains in length eighty-five yards or thereabouts, in breadth thirty yards or thereabouts having on the southside thereof of the aforesaid Howe and adjoins to the river of Douglas on the north side thereof and adjoins on the east and west ends thereof to the lands of me, the said Thomas Heywood together with a road or passage sufficient at the east and west ends thereof sufficient for the said Philip Higgins, his heirs and assigns with his and their carts and all other carriages to go, to come, pass and repass to and from the said premises together with a free passage over the said river to and from the said town of Douglas, commencing from the second day of February next ensuing the date hereof, the said premises being of such yearly Lord's Rent as the Setting Quest shall settle thereon

To have and to hold the said land hereby granted unto him the said Philip Higgins, his heirs, executors, and administrators and assigns forever, together with all ways, waters, watercourses, easements, liberties, and advantages to the same premises belonging or appertaining, yielding and paying yearly and every year the annual rent to the right honourable Lord of this Isle, together with all other dues, duties and services due and of right accustomed

And I the said Thomas Heywood and Hester my said wife do, for ourselves, our heirs, executors, administrators and assigns hereby covenant, grant and agree to and with the said Philip Higgins, his heirs and assigns that we will from time to time and at all times hereafter uphold, awarrant and maintain the peaceable and quiet possession of the said premises unto the said Philip Higgins, his heirs and assigns against the pretence, claims or title of any person or person whatsoever the right of the honourable Lord of this Isle only excepted and to do, perform and fulfil or cause to be done, performed and executed any other act or acts, things or devices in the law whatsoever for the better and more perfect assuring the said premises unto him the said Philip Higgin, his heirs and assigns and to procure the honourable Court's confirmatin of this deed

And for the true and punctual performance of all and singular the said premises, I the said Thomas Heywood and Hester my said wife do bind and oblige ourselves, our heirs, executors, administrators and assigns in the penalty and forfeiture of four hundred pounds to be levied and paid in the nature of all fines within this Isle of Man

Capt Thomas Heywood and Mrs Hester Heywood acknowledged the beforewritten Bill of Sale to be their voluntary act and deed. Before me, John Taubman

At an Abbey Court holden at Ballysally the 31st May 1746 The beforegoing Bill of Sale being acknowledged before the Deemster and now openly published in Court and no objection offered againt it, the same is therefore allowed of and confirmed according to law. NOTES

  1. Phil Higgin jnr was the son of Philip Higgin snr and Jane Mc ylroy. He was born in 1711 in Douglas
  2. Jane was the daughter of Hen McYlroy & Amy McYlroy als Joyner als Watson. She was under age when her mother died in 1689; her father died later in the same year
  3. She had two Joyner step-siblings: Robert & Alice
  4. Jane inherited a small cottage allotment in Douglas from her father (#110, 4d rent) - in LA 1700, allotment #91 with a 4d rent was jointly tenanted by Hen & John Mcylvorrey, presumably the same (renumbered) cottage allotment, Hen presumed to be her father
  5. Philip sold sold the tholtan he inherited from his father (Gellings Court #111, rent 3d)
  6. So over the years, Philip & Jane sold their legacies but purchased other properties in Douglas
  7. Jane and Phil snr had children Margaret (1704), William (1706), Jane (1708), Philip (1711), Emma (1719) of whom two survived to adulthood
  8. Philip snr was a mariner and Philip jnr was a hairdresser and wig maker
  9. Philip jnr married three times: Elizabeth Peel 1741 (d1750), Mary Halt 1751 (d1761) then widow Sarah Merydew als Scott 1761 (Edward Fletcher was witness to this third wedding)
  10. He had four children - Mary 26th January 1742/3, Philip 4th March 1743/4, Jane 25th February 1746/7, of whom only Jane survived her father
  11. Two burials of a Philip Higgin are recorded in the Braddan parish register, 1741 & 1769, father and son
  12. Phil Higgin snr did not leave a will but the LV 1743 records the fact that he made a gift of two cottages in 1737 to his son, Phil jnr, the year after Jane died. Their rent was respectively 2s 7d, and 20½d, for cottage allotments #48 & #52 ((TBF might be NSS May 1743 #43)
  13. In less than a century, little family of Philip snr and Jane was ""daughtered-out"
  14. NOTE: Be aware that cottage allotment numbers changed over time as Douglas expanded. Rent and neighbours become key elements in confirming whether the tenants (e Phil Higgin) have changed properties or whether they have remained stable while the allotment number from one LA to the next
